ORDINANCE NO. 2390

 

LEASING THE SOUTH 50 FEET OF LOTS 9 THROUGH 12, BLOCK 139 OF THE CITY OF GRAND JUNCTION AND THE BUILDING SITUATE THEREON FOR USE OF STORING CRIMINAL EVIDENCE.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

1. That the City Manager is hereby authorized, and directed, to execute a lease dated June 15, 1988, attached hereto and incorporated herein by this reference.

 

2. As provided in said lease the essential terms are:

 

(a) The South 50 feet of Lots 9 through 12, Block 39, of the City of Grand Junction and the building situate thereon are leased for use of storing criminal evidence;

 

(b) it is the express intent of the parties that the property and improvements, for so long as they are so used by the City, be exempt from ad valorem taxation pursuant to C.R.S. 31-15-802;

 

(c) the City shall maintain the property in accordance with the terms of the lease and shall indemnify the lessor and hold it harmless as set forth in the lease;

 

(d) if lessor desires to sell the property, the City shall be afforded the first opportunity to purchase the property as set forth in the lease.
