ORDINANCE NO. 2394

 

AMENDING SECTION 17-106 OF THE CITY CODE TO PROVIDE FOR ADOPTION OF AN INCREASE IN REQUIRED FEES TO BE PAID AS A CONDITION OF OBTAINING A CONCRETE SIDEWALK OR CURBING LICENSE.

 

WHEREAS, primarily as a consequence of the Uranium Mill Tailings Remedial Action Program, there are many contractors performing tailings removal with concomitant concrete construction in the City of Grand Junction's rights-of-way; and

 

WHEREAS, said contractors are required by law to obtain a license prior to the performance of such work; and

 

WHEREAS, the issuance and removal of sidewalk and curbing contractor licenses requires a considerable amount of City staff time and other costs which are not being presently recovered; and

 

WHEREAS, the current fee for the issuance and annual renewal of a City sidewalk and curbing contractor's license fee is $1.00, which fee is substantially below the actual cost to the City of Grand Junction for the labor and materials required to issue such license; and

 

WHEREAS, the Public Works Department of the City has completed a study evaluating the estimated cost of issuance and renewal of such licenses;

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

1. Section 17-106 of the Grand Junction City Code is hereby repealed and reenacted to read in its entirety as follows:

 

a. Any person (including partnerships, corporations or any other form of doing business) engaged in or performing the services of, contracting for, constructing or repairing of, concrete sidewalks or curbing in the City of Grand Junction shall first procure a license therefor, to be issued by the City Engineer, for a one (1) year term expiring each January 1, upon application made to such City Engineer.

 

b. For the purposes of this Section, the term concrete sidewalk or curbing shall include, but not be limited to, cross pans, gutters, driveways, curbs and sidewalks located partially or wholly in the public right-of-way.

 

c. Any person receiving an initial license shall pay $25.00 to the City of Grand Junction; a person who did not obtain a license for the previous year shall pay the fee required for an initial license.

 

d. Any person receiving a renewal license shall pay $15.00 to the City of Grand Junction.

 

e. Because the costs of issuance of the license are the same for a person receiving a license during the year as they are for a license issued on or about January 1, no prorations of the fee are allowed.
