ORDINANCE NO. 2398

 

VACATING THAT PORTION OF SECOND STREET BETWEEN THE SOUTH LINE OF WHITE AVENUE AND THE NORTH LINE OF ROOD AVENUE; THAT PORTION OF ROOD AVENUE LOCATED 50 FEET EAST OF THE EAST LINE OF THE INTERSECTION OF FIRST STREET AND ROOD AVENUE TO THE WEST LINE OF THE SECOND STREET AND ROOD AVENUE INTERSECTION; THE EAST/WEST ALLEY IN BLOCK 100, EXCEPT THE WESTERNMOST 50 FEET; THE EAST/WEST ALLEY IN BLOCK 99; THE WEST 100 FEET OF THE EAST/WEST BLOCK 98.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

Those rights-of-way described as follows:

 

That portion of Second Street between the south line of White Avenue and the north line of Rood Avenue; that portion of Rood Avenue located 50 feet east of the east line of the intersection of First Street and Rood Avenue to the west line of the Second Street and Rood Avenue intersection; the east/west alley in Block 100, except the westernmost 50 feet; the east/west alley in Block 99; the west 100 feet of the east/west alley in Block 98,

 

are vacated, subject to the following conditions:

 

1. This vacation ordinance shall not be effective until such time as City Market, Inc., a Colorado Corporation, has received title to the real property owned by the City of Grand Junction, described as follows: Lots 1 through 25, inclusive, in Block 100, Grand Junction, Mesa County, Colorado;

 

2. The City of Grand Junction reserves unto itself and entities providing public utility services, such as, but not limited to, telephone companies, electric companies and gas companies, the following easement, which easements shall be perpetual and which may be used for any public purpose as determined solely by the City of Grand Junction:

 

a. An easement 20 feet in width (above the existing telephone underground conduit system) from First Street to Second Street, the centerline of which lies in the center of the east/west alleys to be vacated in Blocks 98 and 99;

 

b. An easement 20 feet in width on the centerline of Rood Avenue between First and Second Streets;

 

c. An easement 20 feet in width on the centerline of the east/west alley between First and Second Streets in Block 100.

 

PASSED and ADOPTED this 7th day of September, 1988.

I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 2398, was introduced, read, and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 17th day of August, 1988, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said City, at least ten days before its final passage.
