ORDINANCE NO. 2407

 

AN ORDINANCE DECLARING THE NECESSITY TO TAKE PRIVATE PROPERTY BY EMINENT DOMAIN AND SPECIFYING AND DESCRIBING THE PROPERTY TO BE TAKEN.

 

WHEREAS, the City Council has determined that it is necessary to improve Main Street and to construct a Visitors Center on certain property previously acquired by the City of Grand Junction; and

 

WHEREAS, the City Council has determined that additional property described as,

 

Lots 20, 21, and 22 in Block 100 of the City of Grand Junction, and Lots 23 and 24 in Block 100 of the City of Grand Junction, all in Mesa County, Colorado, with street address of 118 Main Street, Grand Junction, Colorado 81501 the ("Described Property")

 

will have to be acquired for improvement of Main Street and the construction of the Visitors Center; and

 

WHEREAS, the City of Grand Junction has employed an appraiser to appraise the value of the Described Property; and

 

WHEREAS, the City Council and its staff have reviewed the appraisal prepared by Frank Nisley Jr. and Associates, Inc., dated September 16, 1988; and

 

WHEREAS, the appraisal demonstrates that the market value of the Described Property is $260,000.00; and

 

WHEREAS, the staff and consultants to the City of Grand Junction have previously negotiated with the owner of the Described Property but have been unable to purchase the Described Property.

 

NOW, THEREFORE, be it ordained by the City Council of the City of Grand Junction, Colorado;

 

1. It is necessary to improve Main Street and to construct a Visitors Center on property previously acquired and on the Described Property.

 

2. The appraisal (September 16, 1988) by Frank Nisley Jr. and Associates is hereby approved.

 

3. It is necessary to acquire the Described Property for the improvement of Main Street and the construction of the Visitors Center, and staff and legal counsel are instructed to make a final offer for the purchase of the Described Property in the total amount of $260,000.00.

 

4. It is necessary to take the Described Property by the exercise of the owner of eminent domain if the owners of the Described property reject a final offer of $260,000.00. If the final offer should be rejected, legal counsel is instructed to obtain immediate possession of the Described Property pursuant to applicable eminent domain statutes.
