ORDINANCE NO. 2408

 

AMENDING SECTION 16-9 OF THE MODEL TRAFFIC CODE TO ALLOW U.S. POSTAL SERVICE VEHICLES TO DRIVE ON SIDEWALKS

 

RECITALS:

 

The City of Grand Junction has previously adopted by reference that Model Traffic Code for Colorado Municipalities, 1977 Revised Edition, including section 16-9 thereof. That section currently prohibits driving on sidewalks. The United States Postal Service has requested that the said section be amended to allow the drive of an official postal service vehicle, when delivering mail to residential locations, to drive on sidewalks in order to reduce the cost of mail delivery service. The City Council, upon due deliberation, concludes that such request would serve the public's best interest so long as such driving can be done in a safe manner with due regard to the safety of persons and property.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

Section 16-9 of the Model Traffic Code, 1977 Revised Edition, as previously adopted, is hereby amended so that such section shall read in its entirety as follows:

 

"Section 16-9. Driving on a sidewalk

 

No person shall drive any vehicle upon a sidewalk or a sidewalk area within this municipality except upon a permanent or duly authorized temporary drive, and except that any employee or agent of the United States Postal Service, when in the performance of such person's duties of delivering mail, shall be allowed to drive on a mountable sidewalk or a mountable sidewalk within the City limits of the City of Grand Junction where such driving shall not constitute a danger to persons or property, and where such driving is in a vehicle the gross vehicle weight of which does not exceed four thousand five hundred (4,500) pounds."
