ORDINANCE NO. 2414

VACATING A PORTION OF WILLOWBROOK ROAD IN WILLOWBROOK SUBDIVISION REPLAT

WHEREAS, the City of Grand Junction Department of Public Works, Engineering Division, has petitioned for the vacation of the hereinafter described portion of Willowbrook Road right-of-way in Willowbrook Subdivision Replat; and

WHEREAS, such vacation has been approved by the Planning Commission of the City of Grand Junction; and

WHEREAS, the City Council of the City of Grand Junction has determined that such vacation would not be detrimental to the inhabitants of the City of Grand Junction;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

That the right-of-way more particularly described as follows:

Beginning at a point 148.79 feet east and 32.0 feet north of the southwest corner of Section 2, Township 1 South, Range 1 West of the Ute Meridian, City of Grand Junction, County of Mesa, State of Colorado, and considering the south line of said Section 2 to bear East as a basis of bearings;

thence North a distance of 6.5 feet to a point in the westerly right-of-way line of Willowbrook Road;

thence along said westerly right-of-way line the following two (2) courses:

1. through the arc of a non-tangent curve having a central angle of 41 deg. 17 min. 34 sec., a radius of 25.0 feet, and a long chord which bears N 20 deg. 37 min. 28 sec. E a distance of 17.63 feet;

2. through the arc of a curve to the right having a central angle of 61 deg. 44 min. 51 sec., a radius of 135.0 feet, and a long chord which bears N 30 deg. 52 min. 27 sec. E a distance of 138.55 feet;

thence along the arc of a non-tangent curve having a central angle of 40 deg. 01 min. 34 sec., a radius of 132.0 feet, and a long chord which bears S 69 deg. 59 min. 19 sec. E a distance of 90.35 feet;

thence South a distance of 3.0 feet to a point in the north line of Lot 1 Block 1 of said Willowbrook Subdivision Replat, said point being 19.0 feet West from the Northeast corner of said Lot 1;

thence along the boundary line of said Lot 1 the following three (3) courses:

1. West a distance of 21.0 feet;

2. along the arc of a curve to the left having a central angle of 90 deg. 00 min. 00 sec., a radius of 85.0 feet and along chord which bears S 45 deg. 00 min. 00 sec. W a distance of 120.21 feet;

3. along the arc of a curve to the left having a central angle of 47 deg. 43 min. 56 sec., a radius of 25.0 feet and a long chord which bears S 23 deg. 51 min. 12 sec. E a distance of 20.23 feet;

thence South a distance of 4.5 feet;

thence West a distance of 64.39 feet to the point of beginning,

is hereby vacated, reserving unto the City of Grand Junction and entities providing public utility and irrigation services, easements such as, but not limited to, the following:

1. A 15 foot wide easement for the operation and maintenance of an existing City of Grand Junction waterline;

2. A 15 foot wide easement for the operation and maintenance of an existing Public Service Company gas line;

3. A 15 foot wide easement for the operation and maintenance of an existing First Fruitridge Irrigation District pipeline.

4. A 10 foot wide easement along the westerly 10 feet for public ingress and egress.

PASSED and ADOPTED this 21st day of December, 1988.

I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 2414, was introduced, read, and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 7th day of December, 1988, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said City, at least ten days before its final passage.
