ORDINANCE NO. 2419

VACATING A PORTION OF A UTILITY EASEMENT ON LOT 16-5, CRESTVIEW TOWNHOMES, A REPLAT OF LOT 16 AND 17, CRESTVIEW SUBDIVISION

WHEREAS, the requirements for vacating an easement, set forth in Section 8-3 of the Zoning and Development Code, have been satisfied.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

That portion of the utility easement located on the Northern portion of Lot 16-5, Crestview Townhomes, a replat of Lot 16 and 17, Crestview Subdivision, a subdivision of the City of Grand Junction, Mesa County, Colorado, and being more specifically described as follows:

Commencing N 89 deg. 58 min. 40 sec. W along the North line of said Lot 16-5, a distance of 10.00 feet to the True Point of Beginning; thence S 00 deg. 01 min. 20 sec. W, 10.00 feet; thence N 89 deg. 58 min. 40 sec. W, 54.31 feet; thence N 45 deg. 00 min. 00 sec. E, 14.14 feet to a Point on the North line of said Lot 16-5; thence S 89 deg. 58 min. 40 sec. E along said North line 44.32 feet to the Point of Beginning, containing 489.3 square feet

is hereby vacated.

The plat by which the subject easement was created dedicated said easement to the homeowners. Therefore, the Council acknowledges that this Ordinance serves only to extinguish the City's and the general public's interest in said easement and does not attempt to affect the rights of homeowners whose lots were platted by the replat of Lots 16 and 17, Crestview Subdivision.
