ORDINANCE NO. 2430

AN ORDINANCE REPEALING AN REENACTING SECTION 19-81 OF CHAPTER 19 OF THE CODE OF ORDINANCES OF THE CITY OF GRAND JUNCTION IN ORDER TO PROVIDE NEW PENALTIES FOR VIOLATION OF A SECTION OF CHAPTER 19 OF THE CODE OF ORDINANCES

WHEREAS, the City Council of Grand Junction has previously adopted and passed Ordinance 2001, which ordinance did not provide for different possible penalties for those persons 18 years of more of age and those under 18 years of age; and

WHEREAS, the City Council in the interest of the public health, safety and welfare desires to provide appropriate penalties for violations of, or failing to comply with provisions of Chapter 19 of the Code of Ordinances;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

That the Code of Ordinances of the City of Grand Junction is amended by repealing and reenacting Section 19-81 of Chapter 19 to read as follows:

SECTION 19-81. PENALTY.

Unless otherwise specifically provided in the Code of Ordinances, any person eighteen (18) years of age or older, partnership, firm or corporation violating or failing to comply with any provision of Article I, II, III, IV, V, and VI of this Chapter which is required, prohibited or declared to be unlawful shall, upon conviction, be fined in a sum not to exceed one thousand dollars ($1000.00) for each conviction or imprisoned for a period not to exceed ninety (90) days, or required to perform useful public service not to exceed forty-eight (48) hours, or any combination of such fine, imprisonment or useful public service.

Any person under eighteen (18) years of age violating or failing to comply with any provision of Article I, II, III, IV, V and VI of this Chapter which is required, prohibited or declared to be unlawful, upon conviction, shall be punished by a fine of not more than one thousand dollars ($1000.00), or required to perform useful public service not to exceed forty-eight (48) hours, or both such fine and useful public service.
