ORDINANCE NO. 2499

RECITALS.

The City Zoning and Development Code provides for various fees to be paid pursuant to section 2-2-2(G). There are, however, no fees set forth which specifically apply to the resubdivision of lands nor to adjustments to property lines.

The purpose of this ordinance is twofold: to provide for a specific fee for the two activities described, and to allow for changes in the fees by resolution of the City Council. The Council determines that fees may be changed by Resolution, instead of by ordinance, in order to avoid the costs involved in two readings of an ordinance, and in order to allow for corrections or adjustments to the fee schedule in a timely fashion.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

1. Section 2-2-2(G) of the Zoning and Development Code of the City of Grand Junction, also codified as chapter 32 of the Code of Ordinances, is amended: (a) by the addition of a new subsection numbered (18) which shall read as follows: "18. Resubdivision and Adjustment to Property Lines - $50.00."; (b) by the addition of a new sentence to be located after the first complete sentence in 2-2-2(G) which new sentence shall read as follows: "City Council may, by the adoption of a Resolution, increase, decrease or otherwise modify any of the fees set forth."

2. The Council finds that the enactment of this ordinance is necessary for the preservation of the public health, welfare, and safety and to ensure that those who require or obtain the services of the City's personnel pay a portion of the costs involved in providing such services.

Introduced this 21st day of November, 1990.

PASSED and ADOPTED this 19th day of December, 1990.
