ORDINANCE NO. 2504

RECITALS.

The purpose of this ordinance is to make consistent the City's existing code and state statutes concerning the legal age to consume beer. The state law recently changed the legal drinking age; that change made this ordinance necessary.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

Section 19-29 of the Code of Ordinances of the City of Grand Junction is hereby amended so that said section shall read in its entirety as follows:

"It shall be unlawful for any person to drink malt, vinous or spirituous liquor in the city in or on any public street, road, highway, alley or public way which is either publicly or privately owned and used by the public except a person who is twenty-one (21) years of age or older may drink beer from a can or cup which is other than glass on the grassed areas of a public park unless otherwise prohibited by appropriate notice. The fact that a person is in or upon a motor vehicle at the time of such drinking shall not be a defense in prosecution under this section. The foregoing provisions shall not apply when such public place is a part of the premises designated under a valid license issued pursuant to the Colorado Beer Code (C.R.S. 12-46-101, et seq.).

The amending of this section does not alter Section 19-29.1 entitled `Glass containers prohibited in city parks.'"

Introduced this 6th day of February, 1991.

PASSED AND ADOPTED this 20th day of February, 1991.
