ORDINANCE NO. 2559

 

AN ORDINANCE VACATING THAT PORTION OF THE EAST-WEST ALLEY BETWEEN BELFORD AND TELLER AVENUES WHICH LIES WEST OF 7TH STREET AND EAST OF THE EXISTING NORTH-SOUTH ALLEY.

 

WHEREAS, the adjacent property owner has agreed to dedicate 8.5 feet additional width to the east side of the north-south alley between the requested vacation and Belford Avenue, and

 

WHEREAS, the requirements for vacating a right-of-way, set forth in section 8-3 of the Zoning and Development Code, have been satisfied.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRANT JUNCTION:

 

The east-west alley lying north of Lot 16, Block 17, City of Grand Junction, Mesa County, Colorado, EXCEPT the west 8.5 feet,

 

is hereby vacated;

 

subject, however, to the following reservation: an easement for the use and benefit of the City of Grand Junction, for itself and other utilities with the consent of the City, utilities operation, installation and repair over, under, through and across the above described parcel.
