ORDINANCE NO. 2639
WHEREAS, the requirements for vacating a right-of-way, set forth in section 8-3 of the Zoning and Development Code, have been satisfied;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:
A right-of-way for Gunnison Avenue more specifically described as follows:
That portion of Gunnison Avenue right-of-way as described in Book 1050, Page 307 and 308 and in Book 1059 Page 684 and the final plat for Gunnison Avenue South in the records of the Mesa County Clerk and Recorder lying 30 feet east of the west line W½ E¼ NW¼ NE¼ of Section 18, Township One South, Range 1 East of the Ute Meridian and 30 feet west of the east line W½ NE¼ NE¼, of Section 18 Township One South, Range 1 East of the Ute Meridian.
Is hereby vacated. This vacation is subject to a 60 foot wide easement for utilities, said easement to be centered on the vacated right-of-way. The vacation is also subject to the dedication of 30 feet of right-of-way for Melody Lane from a parcel of property owned by the petitioner and located northwest of Melody Lane and said Gunnison Avenue right-of-way. Also, as a condition of this vacation, the petitioner shall process an adjustment of property lines so that all parcels shall have frontage on a dedicated right-of-way.
