AN ORDINANCE OF THE CITY OF GRAND JUNCTION AMENDING CHAPTER 4, ALCOHOLIC BEVERAGES, SECTIONS 4-1 AND 4-31, OF THE CODE OF ORDI­NANC­ES

 

Recitals.

 

 The City Council of the City of Grand Junction has appointed a Hearing Officer as the local licensing authority in accordance with the permission granted in 12-46-103(4) C.R.S., as amended, and 12-47-103(9), C.R.S., as amended. The Hearing Officer conducts all hearings required under the Liquor and Beer Codes for the issuance of all licenses, other than special events permits.

 

 12-48-107, C.R.S., Applications for special permit, provides that "applications for a special events permit shall be made with the appropriate local licensing authority".

 

 The City Council has determined that it is appropriate to amend the Code of Ordinances for the City of Grand Junction to provide that the Hearing Officer, as duly appointed, shall review special events permits under the provisions of 12-48-101, C.R.S., et. seq., as amended.

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT:

 

 1. Section 4-1 of the Code of Ordinances of the City of Grand Junction is hereby amended by the addition of the following subsec­tion:

 

 (g)  Under the authority granted in 12-48-107 (1) and (2), C.R.S., as amended, an application for a special event permit shall be filed with the local licensing authority and shall be accompanied by a fee for both investigation and issuance of said permit of twenty-five dollars ($25.00).

 

 2.  Section 4-31 of the Code of Ordinances of the City of Grand Junction is hereby amended to read as follows:

 

   Sec. 4-31. Duties of the hearing officer.

 

    The hearing officer shall conduct all hearings required under the Liquor and Beer Codes for the issuance of all licenses and shall conduct all hearings to deter­mine the renewal of licenses, for proposed changes of ownership of licenses and changes of the structure of the licensed premises and for proposed changes of location of the licensed premises, and shall conduct all hearings brought under the codes when violations of the codes or the regulations under the codes have been alleged to have occurred.
