CITY OF GRAND JUNCTION, COLORADO

 

       ORDINANCE NO. 2703

 

   Ordinance Vacating Rights-of-Way located South of HWY 50

   and West of Linden Street

 

Recitals.

 

 A vacation of two alley and one street right-of-way has been requested. These rights-of way were platted as part of the Orchard Mesa Heights Subdivision but never constructed or improved. The proposal does not landlock or restrict access to any parcel of land. The review process has determined that there is no public need for these rights-of-way and that benifits will be derived by placing these rights-of-way back into private ownership.

 

 After public notice and public hearing as required by the Zoning and Development Code, the Grand Junction Planning Commission recommends approval of the vacation of these rights-of-way as requested by the petitioner.

 

 The City Council finds that the requested vacation is in conformance with the stated criteria of Section 8-3 of the Zoning and Development Code.

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT:

 

The alleys in blocks 25 and 26 of Orchard Mesa Heights Subdivision that lie south of the right-of-way for U.S. Hwy 50 and that portion of Palisade Street as platted in Orchard Mesa Heights Subdivision that lies south of the right-of-way for U.S. Hwy 50 are hereby vacated.

 Introduced on first reading this 18th day of August, 1993.

 

 PASSED and ADOPTED on second reading this 1st day of September, 1993.
