 VACATING AN ALLEY BETWEEN PROPERTY LOCATED

 AT 2651 & 2659 U.S. HIGHWAY 50

Recitals.

 The existing structure located at 2651 U.S. Highway 50 encroaches upon the alley right-of-way which is requested to be vacated. The right-of-way is presently used for overhead utilities but, because of the encroachment of the builidng and a utility pole in the middle, it is not used as a through alleyway.

 Except for that portion covered by the building, the vacated alley will be retained as a utility easement.

 The Grand Junction Planning Commission at their September 7, 1993 hearing recommended approval of the vacation.

 The City Council has duly considered the matter and the recommendation of the Planning Commission and finds that the requirements for vacation of a right-of-way, as set forth in section 8-3 of the Zoning and Development Code, have been satisfied.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

That the alley right-of-way described below is hereby vacated:

That portion of the north-south alley that lies between Lots 17 to 19 inclusive on the easterly side, and Lots 20 to 25 inclusive on the westerly side, and the northerly right-of-way of Dominguez Avenue, and the southerly right-of-way of U.S. Highway 50, all in Block 20, Orchard Mesa Heights Subdivision, south of U.S. Highway 50 in the City of Grand Junction, Colorado;

and that the area described below shall be retained as a utility easement:

That portion of the alley in Block 20, Orchard Mesa Heights Subdivision, lying South of U.S. Highway 50 beginning at the Southeast corner of the Utility Easement which is identical with the Southwest corner of Lot 19; thence N 89 deg 36 min 15 sec W, 20.00 feet; thence N 00 deg 34 min 01 sec W, 11.89 feet; thence S 77 deg 03 min 04 sec E, 11.66 feet; thence N 00 deg 03 min 39 sec W, 13.09 feet; thence N 01 deg 53 min 34 sec W, 15.83 feet; thence S 69 deg 30 min 52 sec W, 6.40 feet; thence N 64 deg 27 min 07 sec W, 5.64 feet; thence N 00 deg 34 min 01 sec W 59.82 feet; thence S 64 deg 51 min 15 sec E, 22.20 feet; thence S 00 deg 34 min 01 sec E, 88.92 feet to the Point of Beginning.
