AN ORDINANCE AMENDING SECTION 19-29 OF THE GRAND JUNCTION CODE OF ORDINANCES CONCERNING THE DRINKING OF ALCOHOLIC BEVERAGES IN PUBLIC WAYS
Recitals.
The Grand Junction Code of Ordinances currently prohibits the consumption of any malt, vinous or spirituous beverage of liquor in any public way or private way used by the public.
The Colorado Revised Statutes, as amended, allow the local licensing authority of a municipality to issue a Special Events Permit to non-profit organizations for the sale of malt, vinous and spirituous liquors pursuant to the requirements of 12-48-101 C.R.S. et. seq.
The City receives numerous requests from non-profit organizations for Special Events permits, requesting authorization to sell malt, vinous and spirituous liquors at events held in public ways, particularly in the Downtown Shopping Park area.
After due consideration, the City Council has determined that it is proper and justified to amend the Code of Ordinances to allow consumption of malt and vinous beverages in public ways and private ways used by the public, when and if such possession and consumption is authorized under a Special Events Permit, properly applied for and granted by the Local Licensing Authority in accordance with 12-48-101 C.R.S, et. seq. Consumption of spirituous liquors in such public ways and private ways used by the public will still be unlawful.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF GRAND JUNCTION, COLORADO THAT:
Section 1. The Code of Ordinances, Chapter 19, Section 29 is hereby repealed and reenacted to read as follows:
Sec. 19-29. Drinking of alcoholic beverages in public ways; use of glass containers in grassed areas prohibited.
It shall be unlawful for any person to drink malt or vinous beverages in the city, in or on any public street, road, highway, park or public way which is either publicly or privately owned and used by the public, unless such possession and consumption is pursuant to and in accordance with a Special Events Permit issued in accordance with 12-48-101 C.R.S., et. seq. or such public place is a part of the premises designated under a valid license issued pursuant to Colorado law and the consumption is otherwise lawful. Consumption of spirituous liquors in or on any public street, road, highway or public way which is either publicly or privately owned shall be unlawful. No person shall drink from or use glass containers on the grassed areas of any public park.
