ORDINANCE NO. 2779

 

 AN ORDINANCE AMENDING CHAPTER 25, ARTICLE 9, SECTION 25-44

 OF THE CODE OF ORDINANCES,

 REGARDING RESTAURANT GREASE TRAPS

 AND ASSESSMENT OF FEES FOR NON-COMPLIANCE.

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT:

 

"Chapter 25, Section 25-44 of the Code of Ordinances of the City of Grand Junction is amended by the addition of subparagraph 4d which reads as follows:"

 

Section 25-44, Subsection 4. Service charges.

 

4.  Restaurants:

 

   a)  24-hour operation = 0.21 x number of seats;

   b) 12-hour or less operation - 0.14 x number of seats;

   c)  Bar, no food = 0.04 x number of seats;

   d)  Restaurants which are unable to install required grease interceptor(s) due to insufficient on-site area, shall be assessed additional wastewater treatment and/or disposal fees. Fees shall be assessed in order to eliminate any economic benefit which results or may result by virtue of non-compliance with the Code requirement that grease interceptor(s) be installed. The Director, in his sole and absolute discretion, shall determine if sufficient on-site space is available for the required installation. The existence or configuration of parking lot(s), utility service lines) or other site characteristics or constraints shall not be considered sufficient cause for waiver of the installation requirement. Any and all fees authorized by this paragraph shall be assessed by the Director or his designee as approved from time to time by resolution of the City Council.
