 VACATING THE EAST 200 FEET OF AN ALLEY RIGHT-OF-WAY IN BLOCK 77

Recitals.

 This right-of-way vacation request is being processed simultaneously with a rezone request in part of Block 77 to allow for the construction of a nonresidential use with accessory parking.

 The Grand Junction Planning Commission, at its April 4, 1995 hearing, recommended approval of this right-of-way vacation subject to reservation of the entire right-of-way as a utility easement and final approval by the Utility Coordinating Committee.

 NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT THE ALLEY RIGHT-OF-WAY DESCRIBED BELOW IS HEREBY VACATED AND RETAINED AS UTILITY EASEMENT:

East 200 feet of the east-west alley located in Block 77.
