VACATING A PORTION OF PEDESTRIAN RIGHT OF WAY

LOCATED IN THE SOUTHWEST QUARTER OF SECTION 8,

TOWNSHIP 1 SOUTH, RANGE 1 WEST OF THE UTE MERIDIAN

[North of South Rim Drive at South Teal Court]

 

Recitals.

 

 This right-of-way (ROW) vacation request is being processed with a major subdivision for South Rim Filing #5, a 15 lot development located adjacent to South Rim Drive. The section of pedestrian ROW is not required for access or maintenance purposes and will have no adverse impact on the operation of the trail. Adequate ROW will remain to accommodate the roadway, pedestrian trail and utilities. The vacated ROW would become part of the private open space system for the South Rim Subdivision and will be developed as a landscaped entrance feature.

 

 NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT:

 

(a) This vacation shall be effective upon recordation of Filing #5 of South Rim

 

(b) The right-of-way hereby vacated is described as follows:

 

 Commencing at the Southwest 1/16th Corner of Section 8, Township 1 South, Range 1 West, of the Ute Meridian, which bears South 89 degrees 47 minutes 07 seconds West, a distance of 1319.34 feet from the Center South 1/16th of said Section 8 with all bearings and distances contained herein relative thereto; thence North 17 degrees 56 minutes 12 seconds West to the POINT OF BEGINNING; thence North 90 degrees 00 minutes and 00 seconds West, a distance of 50.43 feet; thence a non-tangent curve to the left, having a delta angle of 06°09'27", a radius 19 seconds West, and a chord length of 23.85 feet; thence South 65 degrees 01 minutes 37 seconds East, a distance of 56.45 feet; to the POINT OF BEGINNING. Said parcel containing 0.014 Acres, as described.

 

(c) Title to the described property shall rest in the owner of the adjacent "Outlot A Irrigation" as shown on the Final Plat of Filing #1 of South Rim.
