VACATING ALLEYWAYS EAST OF SOUTH 9TH STREET
AND SOUTH OF THE RAILROAD TRACKS
Recitals.
The existing alleyways within and adjacent to the Conoco tank terminal at 631 South 9th Street either have existing development or improvements such as fencing within the rights-of-way. These rights-of-way have never been developed as alleys nor are they likely to ever be needed as such due to the existing pattern of development. Two of the alleyways currently dead-end at the railroad right-of-way. The vacations will benefit Conoco as well as the property owner to the west, Denning Lumber, and the City will benefit by the elimination of maintenance and liability responsibilities for these alleyways and having a more "cleaned up" plat of the area.
The Utility Coordinating Committee (UCC) approved this vacation request at its February 14, 1996 meeting.
The Grand Junction Planning Commission, at its February 6, 1996 hearing, recommended approval of the vacation of these alleyways.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT THE RIGHTS-OF-WAY DESCRIBED BELOW ARE HEREBY VACATED:
Alleyway No. 1 - A 15-foot wide north-south alley in Block 10, Milldale Subdivision, with the northern boundary being the southern line of the D&RGW Railroad right-of-way and the southern boundary being the northern line of the 20-foot wide east-west alleyway in Block 10, Milldale Subdivision.
Alleyway No. 2 - A 20-foot wide east-west alley in Block 10, Milldale Subdivision, with the eastern boundary being the western line of the South 9th Street right-of-way and the western boundary being the eastern line of the north-south 15-foot alley adjacent to the west of Block 10, Milldale Subdivision.
Alleyway No. 3 - A 15-foot wide north-south alley adjacent to the western side of Block 10, Milldale Subdivision with the northern boundary being the southern line of the D&RGW Railroad right-of-way and the southern boundary being the northern line of the Second Avenue right-of-way.
Alleyway No. 4 - A 15-foot wide north-south alley within Block 12, Milldale Subdivision, with the northern boundary being the southern line of the Second Avenue right-of-way and the southern boundary being the northern line of the 20-foot east-west alleyway in Block 12, Milldale Subdivision.
