ORDINANCE NO. 2986
AN ORDINANCE SUBMITTING TO THE ELECTORATE OF THE
CITY OF GRAND JUNCTION THE QUESTION OF THE
SALE OR TRADE OF CERTAIN REAL PROPERTY OWNED BY THE CITY
WHEREAS, the City Council has determined that the City owned real property herein described is surplus and not necessary for park, recreational or governmental purposes; and
WHEREAS, Section 48 of The Charter of the City of Grand Junction, as amended, requires that, before any sale of real property shall be made, the question of such sale and the terms and consideration thereof shall be submitted to and ratified by a majority vote of the registered electors of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:
1. That the herein described real property is not necessary for park, recreational or governmental purposes.
2. That there be submitted to the registered electors of the City of Grand Junction, at the regular election on April 8, 1997, the question of the sale or trade of certain real property owned by the City as hereinafter set forth:
Shall the City Council be authorized to sell or trade, for no less than the fair market value thereof, the following described real property consisting of approximately 17.5 acres of vacant land located North of Patterson Road and West of 30 Road, commonly known as Burkey Park Property; if traded, the lands traded for shall be at least equal in value and shall be used for park purposes, and, if sold, the moneys received shall be used to improve existing park lands or to acquire other park lands:
The West 1/2 of the Southeast 1/4 of the Southeast 1/4 of Section 5, Township 1 South, Range 1 East of the Ute Meridian, County of Mesa, State of Colorado, EXCEPT a tract described as follows: Beginning at the Southwest Corner of the Southeast 1/4 of the Southeast 1/4 of said Section 5; thence North 180.0 feet; thence East 291.2 feet; thence South 180.0 feet; thence West 291.2 feet to the Point of Beginning, ALSO EXCEPT the South 50.0 feet for road right-of-way, ALSO EXCEPT the North 50.0 feet for road right-of-way.
