VACATING A WATER LINE EASEMENT

LOCATED IN THE SOUTHWEST QUARTER OF SECTION 3,

TOWNSHIP 1 SOUTH, RANGE 1 WEST OF THE UTE MERIDIAN

[2584 Patterson Road]

 

Recitals.

 

 This easement vacation request is being processed with a resubdivision request at 2584 Patterson Road. The water line was originally designed to serve Lot 1 of the Tomkins Subdivision to the north but has since been relocated and the subject water line has been abandoned. The easement is not required for other utilities and alternate easements exist to satisfy utility company needs.

 

 NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT THE WATER LINE EASEMENT DESCRIBED BELOW IS HEREBY VACATED:

 

Being an existing 10 foot wide utility easement as shown on the face of the plat for Tomkins Subdivision recorded in Plat Book 14, Page 362, Drawer No. BB52 of Mesa County Records and further described as follows:

 

Commencing at the Southwest corner of the Southwest Quarter of the Southeast Quarter of Section 3, Township 1 South, Range 1 West of the Ute Meridian, from whence the Southeast Corner of said Section 3 lies South 89 degrees 57 minutes 00 seconds East, a distance of 1319.03 feet for a basis of bearing with all bearings contained herein relative thereto; thence South 89 degrees 57 minutes 00 seconds East, a distance of 181.22 feet, thence North 00 degrees 11 minutes 00 seconds East, a distance of 33.00 feet; thence South 89 degrees 57 minutes 00 seconds East, a distance of 99.04 feet to the POINT OF BEGINNING; thence North 89 degrees 57 minutes 00 seconds east, a distance of 5.00 feet; thence North 85 degrees 45 minutes 56 seconds East, a distance of 5.01 feet; thence North 00 degrees 00 minutes 00 seconds East, a distance of 6.33 feet; thence North 26 degrees 45 minutes 53 seconds West, a distance of 296.38 feet; thence South 89 degrees 54 minutes 30 seconds West, a distance of 11.19 feet; thence South 26 degrees 45 minutes 53 seconds East, a distance of 299.02 feet; thence South 00 degrees 00 minutes 00 seconds East, a distance of 4.32 feet to the POINT OF BEGINNING.

 

Said parcel containing an area of 0.070 acres as described.
