VACATING RIGHT-OF-WAY ON

23 1/4 ROAD JUST SOUTH OF RIVER ROAD

 

Recitals:

 

 The vacation includes right-of-way on 23 1/4 Road located south of River Road. The area is 60 feet wide by an average of 464 feet long. This right-of-way is not currently used because 23 1/4 Road takes an alternative route to River Road. It bends to the east and then intersects River Road. This bend avoids crossing the Wilsea drainage ditch and allows a desirable 90 degree intersection with River Road.

 

 An easement will be retained for the Grand Junction Drainage District along the southern portion of the right-of-way for the purposes of maintaining the Wilsea Drain. See the attached exhibit A which shows the easement.

 

 The Planning Commission having heard and considered the request and found the criteria of the Code to have been met recommends that the vacation be approved.

 

 NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT:

 

1. The following described property “parcel A” as depicted on the attached exhibit A is hereby vacated.

PARCEL “A”

 

The West 30 feet of a parcel of land situated in the NE 1/4 SW 1/4 of Section 5, Township 1 South, Range 1 West of the Ute Meridian, being more particularly described as follows:

Beginning at a point on the West line of the NE 1/4 SW 1/4 and centerline of drain ditch which bears North 00º13’20” West 275.26 feet from the Southwest corner of the NE 1/4 SW 1/4 of said Section 5;

Thence North 32º46’30” East along centerline of drain ditch 387.72 feet to the South right-of-way of River Road;

Thence along said right-of-way North 56º54’ West 252.70 feet to the West line the NE 1/4 SW 1/4;

Thence South 00º13’20” East 464.00 feet the Point of Beginning.

 

AND

 

The East 30 feet between River Road on the North and the centerline of the drain ditch on the South of a parcel of land described as follows:

Beginning SE corner of NW 1/4 SW 1/4 Section 5, 1 S 1W North 740.2 feet;

Thence North 56º54’ West 395.25 feet;

Thence South 849.1 feet;

Thence South 89º40’ West 331.5 feet;

Thence South 108.8 feet;

Thence North 89º40’ East 663.1 feet to the Point of Beginning.

 

2. The above vacated right-of-way provided for in this Ordinance is subject to the reservation and retention by the Grand Junction Drainage District, for its use, the following easement as depicted on exhibit A for the installation, operation, maintenance, relocation and repair of the Wilsea Drain on, along, over, under, through and across the following described portion of the hereinabove vacated right(s)-of-way:

 

DRAINAGE EASEMENT

 

Commencing at the SW corner of the NE 1/4 SW 1/4 of Section 5, Township 1 South, Range 1 West, of the Ute Meridian, County of Mesa, State of Colorado;

 

Thence N00º13’20”W along the west line of the NE 1/4 SW 1/4 of said Section 5 a distance of 210.54 feet to the True Point of Beginning;

Thence S32º51’24”W 54.97 feet;

Thence N00º13’20”W 128.25 feet;

Thence N32º51’09”E 109.94 feet;

Thence S00º13’20”E 63.40 feet;

Thence S32º46’30”W 55.08 feet to a point on the west line of the NE 1/4 SW 1/4 of said Section 5;

Thence S00º13’20”E along said west line a distance of 64.72 feet to the True Point of Beginning.
