VACATING A UTILITY EASEMENT ON

SOUTHERN EDGE OF

LOT 7, BLOCK 2 OF NORTHSTAR SUBDIVISION

 

Recitals:

 

 This ordinance vacates a 5’ wide utility easement along the southerly border of lot 7, block 2 of Northstar Subdivision. This vacation is necessary because the corner of the garage extends approximately 6 inches into the easement which could create future hardship with financing and selling of the home. Staff supports the vacation request because it does not reduce quality of public services because the easement in question does not contain any utilities nor are any future utilities anticipated for this location (as indicated by relevant utility vendors);

 

 The Planning Commission, having heard and considered the request and found the criteria of the Code to have been met, recommends that the vacation be approved.

 

 NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT:

 

The following described utility easement is hereby vacated: southern 5 feet of Lot 7 in Block 2 of the NORTHSTAR SUBDIVISION, Mesa County, Colorado.

 

 

INTRODUCED for FIRST READING and PUBLICATION this 15th day of October, 1997.

 

PASSED on SECOND READING this 5th day of November, 1997.
