VACATING A WATER LINE EASEMENT
ON LOT 9, DEL MONTE PARK SUBDIVISION
Recitals:
This ordinance vacates the 10’ wide water line easement located in the center of Lot 9 Del Monte Park Subdivision. The easement is currently not used nor is there any future need for the easement.
The Planning Commission, having heard and considered the request and found the criteria of the Code to have been met, recommends that the vacation be approved.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT:
The following described easement is hereby vacated:
A parcel of land being part of the SW 1/4 of Section 8, Township 1 South, Range 1 West of the Ute Meridian, and crossing lot 9, Del Monte Park Subdivision, being 5 feet each side of the following described centerline.
Commencing at the corner common to Lots 7, 9, and 10, Del Monte Park Subdivision as recorded in Plat Book 11, at Page 40, Mesa County Records, thence South 85º46’00” West, a distance of 10.04 feet to the Point of Beginning; thence South 85º46’00” West, a distance of 155.36 feet to a point on the West line of said Lot 9 and the Point of Terminus; whence the westerly angle point of Lot 9 bears North 00º00’00” East , a distance of 9.02 feet. The above-described easement contains 0.04 acres, more or less.
Basis of bearing: The West line of the Southwest 1/4 of Section 8, Township 1 South, Range 1 West of the Ute Meridian between the Northwest corner and the Southwest corner of said quarter section. Said line bears South 00º00’00” East a distance of 1319.32 feet as shown on the plat of Del Monte Park Subdivision.
