VACATING AN UNNAMED RIGHT-OF-WAY

LOCATED SOUTH OF POWER ROAD, EAST OF DIKE ROAD

 

Recitals.

 

 An unnamed public roadway described in Book 744, Page 341 was previously dedicated on the western lot of the proposed Brach’s Subdivision. It is unclear why this dedication was made. With the redevelopment of an adjoining parcel to the east, this right-of-way must be vacated, continued through or a proper termination installed. The owner desires to vacate it since it does not benefit the development or redevelopment of either lot. The portion of this right-of-way that extends into Power Road will not be vacated. No utilities are located in the right-of-way.

 At its May 18, 1999 hearing the Planning Commission found that the right-of-way vacation conforms to the criteria in Section 8-3 in the Zoning and Development Code and recommends approval of the vacation.

 

 NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 City Council finds that the vacation meets the criteria set forth in Section 8-3 of the Grand Junction Zoning and Development Code and in accordance therewith the following described right-of-way is hereby vacated:

 

 A parcel of land being part of Section 16, T1S, R1W Ute Meridian, as recorded in Book 744, Page 341, Mesa County Records, being more particularly described as follows:

 

Beginning at a point 252’ west and 316’ north of the southeast corner of the NE ¼ SE ¼ Section 16, T1S, R1W Ute Meridian; thence S00°11’30”W 316.00’; thence S89°48’36”E 252.00’ to the southeast corner of the NE ¼ SE ¼ of said Section 16; thence S00°11’30”W 50.00’; thence N89°48’30”W 302.00’; thence N00°11’30”E 370.20’; thence S85°00’24”E 50.18’ to the point of beginning, EXCEPT any portion lying within the existing right-of-way for Power Road as described in Book 1955 at Page 551, Mesa County Records.
